It was good that half of Prop. 8 was upheld, but it was wrong and unconstitutional for the judges to strike down the other half of Prop. 8 by validating some 18,000 homosexual "marriages." State's high court upholds Prop. 8: Randy Thomasson, president of SaveCalifornia.com, a pro-family group supportive of Prop 8 commended the court's decision upholding the measure but called the ruling letting same-sex marriages performed in 2008 stand "counterfeit". "This is unconstitutional and unjust. The court's own rules require that the counterfeit marriages be declared null and void," said Thomasson. "But instead of respecting the clear text of Prop. 8 and by ignoring the clarifying ballot statements, the court has gone with its own feelings and its own social agenda in violation of the judges' solemn oaths to uphold the written constitution. California Supreme Court expected to 'half uphold' Prop. 8: A majority of justices will side with voters, whether they like Prop 8 or not, predicted Randy Thomasson, president of SaveCalifornia.com. But Thomasson also expects the court to hand conservatives a partial defeat by allowing some same-sex marriages performed in California to stand. "Bottom line," Thomasson said, "it's virtually guaranteed that the court will rule that only man-woman marriages could be performed after the vote on Prop. 8, but that nearly four months of homosexual 'marriages' performed before the Election Day will still be recognized. This would be half right and half wrong, not giving the Constitution or the voters the respect they deserve."
