Why Prop. 8 Must Be Upheld
Constitutional, rational defense for real marriage only between 1 man and 1 woman

Sacramento, California -- SaveCalifornia.com, which promotes moral virtues for the common good, and which strongly supports Prop. 8 -- which, in 2008, placed "Only marriage between a man and a woman is valid or recognized in California" -- into the State Constitution, has issued the following statements and background in anticipation of the U.S. Supreme Court's expected June 26 ruling.

SaveCalifornia.com President Randy Thomasson on why Proposition 8 should be upheld and the lower court rulings declaring it unconstitutional should be overturned.

Constitutional/Republic reasons:

"The justices had a simple question before them, and the answer is also simple when you abide by the written Constitution," Thomasson said. "First, marriage is not in U.S. Constitution. Second, the 14th Amendment, which is not about marriage but about race, and not about couples but individuals, does not apply to Prop. 8. Third, the 10th Amendment recognizes states have powers that are not federal powers and that are not prohibited by the Constitution. Fourth, Article IV, Section 4 of the U.S. Constitution guarantees a republican form of government to each state, where a written constitution is the supreme law of the state. Fifth, the California Constitution contains Proposition 8 as Article 1, Section 7.5. Therefore, Prop. 8 must be upheld."

Thomasson has been defending marriage rights for man-woman marriage since 1994. Together with Liberty Counsel, SaveCalifornia.com filed an amicus brief supporting Prop. 8 with the Supreme Court.

Homosexual Behavior Doesn't Qualify As A Civil Right:

There is no "gay gene" -- so homosexuality is not biologically based. The only human genders are male (if you inherited a "Y" chromosome from your father) and female (if you did not inherit a "Y" chromosome from him) -- so homosexuality is not a new "gender."

Not being born "gay" means this is not a "civil rights" issue. "People inherit unchangeable characteristics like their race and ethnicity, but homosexuality is not inherited," Thomasson said. "Science and biology confirm this and thousands of former 'gays and lesbians' who have changed their behavior also prove this fact. Therefore, homosexuality is not a 'civil right' for marriage or anything else."

"There is no 'gay gene,' thus no basis for civil rights designation," Thomasson reiterated. "Consider that race and ethnicity are inherited, but homosexuality is not, as both science and thousands of former homosexuals demonstrate. A changeable behavior is not immutable; therefore homosexuality, bisexuality, bisexuality, transsexuality should not have been given the legal force of non-discrimination laws, such as those based on immutable race and immutable gender."

"Look at what's happened," Thomasson added. "Bestowing civil rights status upon homosexuality and 'gender identity' (transsexuality) has resulted in the severe infringement of Americans' First Amendment rights -- religious freedom, free speech, and freedom of association."

Rational Reasons in Favor of Health, Children, Societal Stability, and Liberty

There are several important, rational reasons why marriage should only be for one man and one woman, and why the notion of homosexual "marriages" should be resisted:

A. Against Health: Male homosexuality has the highest rates of HIV/AIDS and a host of other sexually transmitted diseases, higher cancer rates, and earlier deaths. Documentation

B. Against the Best Interest of Children: "Among the myriad reasons Prop. 8 should be upheld is there are the God-given differences between male and female, the requirement of a man and a woman for procreation, the natural physical fit of a husband and wife, and the fact that children do best with a married father and mother under the same roof," Thomasson said.

Boys and girls raised by female homosexuals have skewed gender identities. Girls are more masculine-acting and more aggressive than normal, and boys are less masculine-acting and more passive than normal. And a significantly greater portion of young adults raised in these homosexual households have experimented with homosexual acts themselves, as compared with those raised in natural family households. C. Against Stability: The marriages of husbands and wives, on average, are 1000% stronger, with 10 times the duration, of homosexuals who cohabitate. There is no such thing as marriage without a man and a woman. And neither can claims of same-sex "commitment" match man-woman marriage. Official census data found 50% of man-woman marriages lasted 20+ years, while only 5% of homosexual couples even claimed this duration (among whom, male homosexual couples often have "open" relationships). D. Against Liberty: In California, there are state laws and court rulings that give homosexuality-bisexuality-transsexuality the force of law. These official policies oppress religious freedom, parental rights, property owner rights, business owner rights, foster parent rights, physician rights, counselor rights, and even Boy Scout rights. Here's the latest intolerant attack by homosexual activists against moral virtues and a private group's right to set its own standards.

What God Says

The California Constitution shows its interest in God's values. Its Preamble states, "We, the People of the State of California, grateful to Almighty God for our freedom, in order to secure and perpetuate its blessings, do establish this Constitution."

Similar honor to God is on our coinage -- "In God We Trust" -- and in our Pledge of Allegiance -- "one nation under God."

People on both sides this debate say "God" and "created," because how we are born or created determines our sexuality at birth.

From Genesis through Revelation, the Bible describes homosexual behavior as sin. Jesus Christ specifically defined marriage as only for one man and one woman in Matthew 19. He also taught that all sexual activities outside of marriage are sin in Mark 7 ("adulteries," "fornications," "lewdness").
