It’s unusually good that a state judge in Sutter County (north of Sacramento) has called Gavin Newsom unconstitutional.
On November 2, Sutter County Judge Sarah Heckman issued a 9-page ruling that a) found Democrat Governor Gavin Newsom violated the California State Constitution when he signed his June 3 “executive order” trying to decrease in-person voting, and b) “prohibited” him from doing anything that “amends, alters, or changes existing statutory law or makes new statutory law or legislative policy.”
This helpful ruling provides a witness that Newsom has been operating as a law unto himself. In her opinion, Judge Heckman noticed the outrageous, unconstitutional deeds and predilections of Newsom:
The Governor takes the position the CESA’s grant of authority to exercise “all police power vested in the state,” allowing him to “promulgate, issue, and enforce such orders and regulations as he deems necessary” authorizes him to legislate by unilaterally amending existing statutory law. Not only is this an active and ongoing controversy between the parties, but it is a critically important one for the Judicial Branch to resolve. The State of Emergency brought about by the COVID-l9 pandemic which was proclaimed by the Governor on March 4, 2020 continues in effect, indefinitely, and the Govemor continues to have authority to act under the CESA. The Governor has issued three executive orders during the current state of emergency specifically regarding the November 3,2020 general election (Def. Exs. 4 and 5; Pl. Ex. D) and has issued more than 50 different executive orders changing numerous California statutes since the state of emergency was declared. (Pl. Ex. F)
The Governor continues to issue executive orders which create legislative policy (Pl. Ex. G.) The evidence persuades the Court it is reasonably probable the Governor will continue issuing executive orders which amend statutory law and create legislative policy under the purported authority of the CESA, violating the California Constitution and the rights of plaintiffs thereunder and giving rise to a multiplicity of judicial proceedings, unless restrained by a permanent injunction.
What’s the practical effect of this good ruling? Unknown at this point. On the one hand, it might not mean much. First, because the June 3 election-related order no longer has any practical purpose; second, because Newsom since late June has been having his Department of Public Health issue most of the Covid-related “orders.” Newsom has been literally hiding behind the state public health officer, who purportedly has unlimited order-making abilities (this is clearly unconstitutional and begs for a lawsuit).
On the other hand, this ruling has the potential to add to the foundations of other lawsuits. Whether currently filed or yet to be filed, liberty-based lawsuits can become “weightier” by quoting the Sutter County ruling. As Republican Assemblyman Kevin Kiley (who, along with Republican Assemblyman James Gallagher, sued Newsom) said, a permanent injunction (which the judge indeed ordered) means “a number of his previous orders would immediately be exposed as unlawful, while others may become newly vulnerable.”
Ultimately, despite Newsom, despite his Department of Public Health, and despite local “public health officers,” elected county supervisors can and should quickly end this destructive, unscientific, anti-people lockdown by terminating their county’s “emergency order” and prohibiting any county monies to enforce any state “epidemic” order (i.e. limits on businesses, face masks, and the like).
It’s all up to county supervisors, as Placer County’s successful reopening has demonstrated. Bottom line, it’s time for county residents get tough. To hold pro-lockdown “Republican” county supervisors to account, pro-liberty county residents must threaten them with defeat at the polls next year unless they fully reopen without any restrictions this month.

California’s Democrat tyrants and establishment “Republicans” have redefined “reopen” as 10% or 25% capacity. But already-hurt small businesses can’t survive on that. Sadly, most California pastors are afraid to fully reopen for ministry. Meanwhile, the non-academic, sexual-indoctrinating government “teacher union” bosses have made it clear they want President Donald Trump defeated more than reopening for in-person classroom instruction.
But the good news is the lockdown lies are breaking down, showing “the emperor has no clothes.” See how the WHO, certain California school boards, and even Democrat mayors are helping!
1. Government-imposed lockdowns are unnecessary and harmful
Dr. David Nabarro, the World Health Organization’s special covid-19 envoy: “We in the World Health Organization do not advocate lockdowns as the primary means of control of this virus … The only time we believe a lockdown is justified is to buy you time to reorganize, regroup, rebalance your resources, protect your health workers who are exhausted, but by and large, we’d rather not do it.
“Lockdowns just have one consequence that you must never, ever belittle, and that is making poor people an awful lot poorer … Just look at what’s happened to the tourism industry in the Caribbean, for example, or in the Pacific because people aren’t taking their holidays … Look what’s happened to smallholder farmers all over the world. Look what’s happening to poverty levels. It seems that we may well have a doubling of world poverty by next year. We may well have at least a doubling of child malnutrition.”
2. California’s school lockdown wall has been breached
Remember 1989 when the Berlin Wall was slowly, then quickly, chipped away and eventually knocked down? That needs to happen — and is starting to happen — with California’s unscientific, unproven, tyrannical lockdown. This week, the lockdown “wall” of two of California’s largest government-school districts was breached when both school boards permitted special-needs children to enjoy in-person classes with a teacher and other children. This reopening for some wins the argument for reopening for all. Because if it’s “safe” for deaf and other disabled children to have in-person public-school classes again, it can’t be “unsafe” for other children to also go “back to school.” Of course, the unscientific, anti-family teacher unions hate any breach of their artificial wall of schools that get paid for not working.

While SaveCalifornia.com and I want children out of the government schools and into home schools or Bible-based church schools, if parents won’t rescue their children, then children returning to government schools will hasten the end of the lockdown (which is what the anti-family teacher unions oppose). When schools reopen, parents will go back to work, and the lockdown will quickly lose its hold. This reality will overcome even Gavin Newsom!
3. California’s big city mayors urge the quick reopening of in-person schools: More cracks in the lockdown wall. This week, while San Diego and Sacramento counties’ school boards voted to permit “special needs” children to receive in-person, group-oriented, classroom instruction, mayors of 13 big cities in California (including the Democrat mayors of Los Angeles, San Francisco, San Jose, and Sacramento), are urging Democrat Governor Gavin Newsom to reopen schools.
This is significant. The mayors’ October 14 letter urges Newsom to order the reopening of in-person classrooms for “1) students with special needs, 2) Title 1 students in areas of highest poverty concentrations, 3) children of essential workers; and, 4) students who have experienced homeless and/or youth in the foster/kin care system, and 5) early learners (K-2nd grade).”
Notably, the mayors’ letter implied they’re concerned about parents leaving the government-run schools for private and home schools, stating, “we are seeing private and parochial schools open much more quickly potentially increasing the disparities between well-resourced and under-resourced schools.”
My takeaways
First, most of these mayors are Democrats and their public voice for reopening government-run schools is certain to be considered by Newsom.
Second, if some children are allowed to go “back to schools,” there are very strong legal arguments for all children to return (unless their parents rescue them from the government system).
Third, once government schools reopen, many parents working from home will go back to work, and this will all hasten the end of the lockdown.
ACTION: Keep resisting this unscientific, unmerited, tyrannical lockdown
1. Every time you individually study or collectively get educated about why your God-given and constitutional liberties matter, your character, knowledge, and resolve improve. You also become stimulated to invite your friends to stand for liberty, at future events.
2. Every public protest is an opportunity to lobby for an end to the lockdown. Your audiences are county supervisors and the general public. Without earned media, you can have modest influence upon county supervisors who might see your protest outside their windows or otherwise hear about it. Without earned media, you can also video your own event and show that to others via email, blog, social media, YouTube, Vimeo, etc.
Yet the most effective way to rally is to “earn media” and therefore reach the public and turn more people against the tyrannical, non-scientific establishment that is hurting real people. Aim for this by inviting TV, radio, and newspapers to cover your event, and working for this “earned media” as much as, or more than, you invite your friends and acquaintances.
So, participating in an anti-lockdown, pro-liberty event actually has four benefits: improve your character, improve your friends’ characters, change minds through your own media, and change minds through “earned media.” Let’s keep persevering and outrun the tyrants!
Lastly, I want to reiterate my strong desire for loving parents to protect their children from 11 statewide school sexual indoctrination laws, terrible peer pressure, and dumbed-down “teaching” by permanently removing their precious boys and girls from the non-academic, dysfunctional, godless government schools. However, if these awful facts plus months of lockdown misery haven’t yet motivated parents to home school or church school their children, let the reopening of government schools serve to help end the lockdown as a whole.

The facts are actually not in dispute. Masks are completely irrelevant in blocking the SARS-CoV-2 virus … Prior to March 2020, there were no scientific journals that asserted that masks could keep out a virus … You have been lied to by the media. Propaganda is not a new phenomenon … Mask mandates are spreading fear and hostility that is changing American culture. We are less friendly, less interactive, more hostile, quicker to be angry with our fellow citizens. Masks are very socially divisive. There is mask shaming, and mask virtue signaling — masks bring a palpable sense of fear that is totally unwarranted by the facts … Wearing masks is a national security issue. When most of the citizenry of our country can so easily be persuaded to do something that is so clearly against our own constitution, our enemies certainly take notice. We are quite literally telegraphing our weakness and social divisiveness to our enemies … There has been a massive propaganda campaign to get you to believe something. But you have it within your power to dismiss the propaganda. A simple internet search reveals that no scientist ever believed a mask, let alone a bandana, was relevant against a virus right up until COVID-19. The myth of masks came from politicians, and when something happens in politics, you can be darn sure it’s done for another purpose … So-called experts keep telling you that a bandana can stop a virus that is 1,000 times smaller than a hair. How stupid do you think we are? To all Americans we say, we will be fooled no longer. The tiny emperor has no clothes.”
Ask yourself — are the authorities following the science on face masks?
In February and March, the WHO, the CDC, and the U.S. Surgeon General all said face masks won’t protect you from catching Covid – or the flu.
And in May, a study of studies on the CDC website found (quote) “improper use [of masks] might increase the risk for transmission” of Covid.
It’s logical, right? If you use the same face mask every day, breathing into it, touching it with your hands, then touching doorknobs and other things – you’re spreading your “ick” to others. Think about how people infected with Covid are using masks to spread their “ick.” And this “improper” behavior is happening all over America.
Now, more people are learning about a new study, posted on the CDC website, found that 84 percent of people wearing masks all or most of the time still became infected with Covid.
See what the Tyrannical Left doesn’t want you or your friends to know:
A Centers for Disease Control report released in September shows that masks and face coverings are not effective in preventing the spread of COVID-19, even for those people who consistently wear them.
A study conducted in the United States in July found that when they compared 154 “case-patients,” who tested positive for COVID-19, to a control group of 160 participants from the same health care facility who were symptomatic but tested negative, over 70 percent of the case-patients were contaminated with the virus and fell ill despite “always” wearing a mask.
“In the 14 days before illness onset, 71% of case-patients and 74% of control participants reported always using cloth face coverings or other mask types when in public,” the report stated.
In addition, over 14 percent of the case-patients said they “often” wore a face covering and were still infected with the virus. The study also demonstrates that under 4 percent of the case-patients became sick with the virus even though they “never” wore a mask or face covering.
You see, except for the political correct lies of the Democrat politicians, Big Media, and Big Pharma which have flooded our culture since late March 2020, all the “health authorities” would have remembered — and not abandoned — the science of masks (they don’t protect you from Covid or the seasonal flu):
What’s more, I discovered that top “authorities” spoke out against general public mask use BEFORE the political correctness set in. For example, on February 29, 2020, U.S. Surgeon General Jerome Adams said don’t wear masks — because, unless you’re a trained expert with the best face masks and face mask protocols, face coverings don’t protect you and will actually invite infection:
“Seriously people — STOP BUYING MASKS!” Adams, an anesthesiologist who has been surgeon general since 2017, wrote on Twitter. “They are NOT effective in preventing general public from catching #Coronavirus, but if healthcare providers can’t get them to care for sick patients, it puts them and our communities at risk!” Adams wrote.
Adams also tweeted: “The best way to protect yourself and your community is with everyday preventive actions, like staying home when you are sick and washing hands with soap and water, to help slow the spread of respiratory illness.” He also said: “Avoid touching your [face] w/ unwashed hands, and wipe down surfaces with cleaning solution or wipes.”
With the mainstream media feeding the frenzy of fear, Americans have bought up millions of masks, even though they won’t be effective in prevention. Unless they are the right kind and fit perfectly, masks are ineffective — and Adams said they may even worsen the spread. “You can increase your risk of getting it by wearing a mask if you are not a health care provider,” Adams said during an interview on Fox & Friends on Monday morning.
And in the month of May, this study of decades of face mask studies appeared on the Centers for Disease Control (CDC) website, which reported, “In our systematic review, we identified 10 RCTs [randomized controlled trials] that reported estimates of the effectiveness of face masks in reducing laboratory-confirmed influenza virus infections in the community from literature published during 1946–July 27, 2018. In pooled analysis, we found no significant reduction in influenza transmission with the use of face masks … Proper use of face masks is essential because improper use might increase the risk for transmission. Thus, education on the proper use and disposal of used face masks, including hand hygiene, is also needed.”
Also this year, the World Health Organization (WHO), in a moment of candor, said face masks are NOT recommended for the general public: “If you do not have any repository symptoms such as fever, cough or runny nose, you do not need to wear a mask,” Dr. April Baller, a public health specialist for the WHO, says in a video on the world health body’s website posted in March. “Masks should only be used by health care workers, caretakers or by people who are sick with symptoms of fever and cough.”
Another honest explanation here from four months ago, by a science-dedicated health site that is honest, unlike the Big Media. It’s full of facts and you ought to read it:
We were frequently confused by the mixed messages coming from public health agencies. Early in the pandemic Dr. Fauci, the U.S. Surgeon General, and the WHO all told the public, in no uncertain terms, not to wear masks. Then, over the course of the next several weeks and months, the CDC twice changed their recommendations, as did the WHO, and the recommendations always contradicted each other!
The CDC made the mistake of telling us cloth masks worked, and they even provided directions on their website for making homemade cloth masks.
To clear up the confusion, I will show that the scientific evidence not only does not support the community wearing of face masks, but the evidence shows that healthy people wearing face masks pose serious health risks to wearers.
Hiding our faces behind masks and isolating in our homes is not the solution, at least not for most people with healthy immune systems. Supporting the health of your immune system, confidently confronting all pathogens, and allowing herd immunity to develop and protect the vulnerable populations should be the goal.
What’s happening in the world today, including the misinformation surrounding community mask wearing, is about political agendas, symbolism, fear, and dividing and isolating the people. It has nothing to do with science.
Bottom line, viruses enter a population, peak, and then subside and “burn out” as infected people recover and develop God-given immunity. Over the last few centuries, this has been consistently documented by Farr’s Law. Science shows face masks don’t protect you from contracting Covid — or the flu. In light of this, face masks only serve to dehumanize you and mark you a slave of political tyrants.
